The platform gomintor.com is owned and run by Mintor (Pty) Ltd, registration number 2014/239349/07, a company incorporated in the Republic of South Africa (hereinafter referred to as “Mintor”).
The service offered is effectively a platform that matches job seekers with businesses to facilitate entry-level recruitment (“the Service”). Reference to platform includes reference to the Service being accessed via various channels, including the website / web platform, whatsapp, facebook, linkedIn, twitter and instagram.
These Terms and Conditions between Mintor and the job seeker govern the provision of this Service by Mintor to the job seeker and by accepting the Terms and Conditions when registering as a job seeker on the platform, the job seeker agrees to be bound by the Terms and Conditions.
The Terms and Conditions is a legally binding document. Mintor may modify the Terms and Conditions periodically and the job seeker will be notified of such modifications to the email address associated with the job seeker’s registered account.
Application and Screening
The job seeker will be required to complete the Mintor profile when registering and before being considered for opportunities.
The job seeker is responsible for ensuring that all information provided to Mintor is accurate and complete at all times. Mintor will be entitled to call upon the job seeker to provide documentary evidence, and/or all other information which Mintor reasonably requires to verify the job seeker’s compliance with this term.
The job seeker herewith consents to Mintor contacting and requesting information from any persons, credit bureaus or businesses, including those mentioned in the application form to obtain any information relevant to the job seeker’s application. The job seeker agrees and understands that any information provided by a third party in this regard to Mintor in confidence will not be disclosed to the job seeker.
If the job seeker is under the age of 18 years old, the job seeker may not register for the Service without consent and approval from the job seeker’s legal parent or guardian and the job seeker may not be recruited for full time employment.
The job seeker agrees and guarantees that the username and password used to log in is for personal use only and will not be passed on to any third party.
When registering as a job seeker, the job seeker agrees to being subjected to a screening assessment to be conducted by HireBright (Pty) Ltd. The screening assessment will be subject to the job seeker accepting the terms and conditions of HireBright (Pty) Ltd in this regard. The job seeker herewith consents to Mintor relaying the results of the screening assessment to potential employers. The screening assessment results of the job seeker will be kept confidential between Mintor and the potential employer, with the potential employer understanding that they are not allowed to distribute these results or any personal information of the job seeker to third parties without the written consent of the job seeker.
The use of the platform and the related Service by the job seeker is free of charge. The internet data and other charges incurred by the job seeker in this regard will, however, be for the account of the job seeker.
Limitation of liability
Usage of the Service offered on the platform is at the job seeker’s own risk and Mintor may not be held liable for any direct or indirect special, consequential, or other damage, loss or liability of whatsoever nature arising out of the job seeker’s access to or use of the Service on the platform.
The Services is provided on an ‘as is’ and ‘as available’ basis and Mintor does not warrant that the Service will meet the job seeker’s specific requirements. Mintor furthermore does not warrant that the Service will be compatible with any particular electronic devices, browsers or other software applications.
Mintor does not guarantee that the job seeker will find employment on the platform or that when the job seeker meets the minimum recruiter requirements and applies for a position on the platform, the job seeker will be successful in its application.
Mintor provides no warranty that the Service generally available through its platform shall remain uninterrupted or error-free or that defects in the Service will be corrected.
Furthermore, Mintor does not guarantee that all files made available for download through the Service or delivered via email will be free of infection or viruses, worms, Trojan horses or any other code that manifest contaminating or destructive properties. Job seekers are solely responsible for ensuring that sufficient measures are in place to offer relevant protection or to satisfy the accuracy of data input and output.
Mintor does not represent or guarantee the truthfulness, accuracy or reliability of information posted by users. Job seekers acknowledge that any reliance on information posted by other users will be at their own risk.
Mintor is not responsible or liable for the deletion or failure to store job seeker data or the loss thereof due to technical failure beyond the control of Mintor.
The job seeker indemnifies Mintor and holds it harmless against any loss, liability, damage or expense suffered or incurred by Mintor (and all costs reasonably incurred in connection therewith, including legal costs on an attorney and own client scale) which arise out of or are connected in any manner whatsoever with use or misuse of, or access to, the platform, the Service, the content, or otherwise from user content, violation of these Terms and Conditions, or infringement by the user, or any third party using the user account or identity in the platform, of any intellectual property or other right of any person or entity.
Third party websites
Where links and pointers have been provided by Mintor to other third party websites, these links are provided without endorsement by Mintor. Mintor is not responsible for the content of linked third-party websites and does not make any representations regarding the content and accuracy of materials on such websites. Linking to third party websites is solely at the users own risk.
Use of the website
Job seekers are prohibited to attempt any violations to the security of Mintor including, but not limited to an attempt to interfere with the host or network by submitting a virus to the platform, overloading or spamming, forging of TCP/IP packet header or any part of the header information in any email or newsgroup posting or by accessing information not intended for such user or logging into a server or account which the user is not authorised to access.
Job seekers are prohibited from posting any information onto the Mintor platform that is obscene, offensive, vulgar, defamatory, threatening, harassing, abusive, hateful, racist, sexist, discriminatory, of a menacing character or embarrassing, or which may cause annoyance, anxiety or inconvenience to another user or any other person or entity; post a sexually-explicit image or statement; post advertisements or solicitations of business; post chain letters or pyramid schemes or that impersonates another person.
Personal information and Privacy
Mintor is a responsible party for purposes of the processing of Personal Information in the course of rendering the Service, as provided for by the Protection of Personal Information Act of 2013 (‘’POPIA’’). Mintor conforms to POPIA in terms of the collection, use and retention of Personal Information and this section of the Terms and Conditions summarises Mintor’s policy in this regard. For purposes of these Terms and Conditions, “Personal Information” is defined in accordance with section 1 of POPIA.
If the job seeker is a European Union member state citizen or temporary resident, the job seeker should request a copy of the Mintor General Data Protection Regulation (GDPR) policy by email from email@example.com
Mintor collects Personal Information from the job seeker when the job seeker voluntarily provides such information when completing the job seeker profile to access the Services, which includes the job seeker: (1) name; (2) surname; (3) identity number; (4) email address; (5) telephone number; (6) physical address; (7) gender; (8) nationality; (9) ethnicity; (10) disability type; (11) languages; (12) skills; (13) educational background; (14) experience; and (15) any other Personal Information which he/she provides to Mintor in connection with the Service.
By voluntarily providing us with access to Personal Information, the job seeker is consenting to our use of it in connection with the rendering of the Service.
POPIA gives the job seeker the right to access information held about him/her. Any access request may be subject to a small administrative fee to meet our costs in providing the job seeker with details of the information we hold about the job seeker. The job seeker may also email us at firstname.lastname@example.org to request that we delete his/her Personal Information from our systems. Mintor will use commercially reasonable efforts to honour the job seeker request. Mintor may retain an archived copy of the job seeker’s records as required by law or for legitimate business purposes (and if so, we will explain this to the job seeker at the time).
Due to the fact that Mintor is committed to ensuring that the privacy of their job seekers is protected, Mintor makes use of Hertzner cloud services when storing the job seeker data. Mintor shall reasonably endeavour to ensure that no job seeker data is accessed in an unauthorised manner for the duration of the agreement. Mintor shall promptly inform the job seeker if any job seeker data has been accessed in an unauthorised manner or if Mintor suspects that such access has occurred.
Mintor, however, reserves the right to track trends based on the job seeker’s use of the Service for statistical purposes or to extend the Mintor Service offering and may freely trade with such statistical data with other organisations, provided that such statistical data is anonymised and is not capable of identifying the job seeker as an individual.
All content, trademarks and data on this platform, including but not limited to software, databases, text, graphics, icons, links, designs and agreements, are the property of or under license of Mintor. As such they are protected by local and international legislation and agreements. Job seekers may download, view and print content from this platform only for private and non-commercial ends.
All intellectual property rights in any data that has been successfully submitted to the Service by a job seeker, however, shall at all times remain the property of the job seeker and Mintor shall acquire no rights in such material except the rights required to fulfill its obligations under these Terms and Conditions.
Should any of the Terms and Conditions be breached by a job seeker, Mintor, at its sole discretion reserves the right to remove, without prior notification, any material from the platform or to suspend, alter or terminate job seeker registration and access to the Service.
Should any part of these terms and conditions be held by a court of competent jurisdiction to be unenforceable, the validity and enforceability of the remainder of the terms and conditions shall not be affected.
Job seekers’ use of the Service is solely at the job seekers’’ own risk and subject to all applicable laws governed by South Africa. Should users outside of this jurisdiction access the platform, they do so at their own risk and are responsible for compliance with applicable local laws and regulations.
These Terms and Conditions constitute the whole agreement between the parties and no party shall be bound by any undertakings, representations, warranties, promises or the like not recorded herein.
Any indulgence of whatsoever nature granted by Mintor shall not be construed as a waiver or variation of any of our rights or remedies.
