Recruiter Terms of Use

The platform gomintor.com is owned and run by Mintor (Pty) Ltd, registration number 2014/239349/07, a company incorporated in the Republic of South Africa (hereinafter referred to as “Mintor”).

The service offered is effectively a platform that matches job seekers with businesses (“Recruiters” or “Users”) to facilitate entry-level recruitment (“the Service/s”).

The Services on offer may include the sourcing of the job seekers, collection of the required documents, screening for suitability against criteria, shortlisting of top-matched job seekers, scheduling of interviews for the Recruiter, scheduling of assessment for the Recruiter, reference checking of job seekers and liaising with job seekers on placement outcomes.

These terms and conditions between Mintor and the Recruiter govern the provision of this Service by Mintor to the Recruiter and by accepting the terms and conditions when registering as a Recruiter on the platform, the Recruiter agrees to be bound by the terms and conditions. The terms and conditions are a legally binding document.

Mintor may modify the terms and conditions periodically and the Recruiter will be notified of such modifications to the email address associated with the Recruiter’s registered account.

 

Recruiter Account

The Recruiter Administrator will not create an account for an entity unless he/she is expressly authorised to do so on behalf of that entity. The Recruiter is responsible for ensuring that all information provided to Mintor is accurate and current at all times. Mintor will be entitled to call upon the Recruiter to provide documentary evidence, and/or all other information which we reasonably require to verify the information provided when creating an account.

By registering for the Service, the Recruiter grants permission to Mintor to collect, store and use information in accordance with these terms and conditions.

 

Payment of Fees

In consideration for the Services rendered, the Recruiter shall pay to Mintor a fee as specified on the Mintor platform or as otherwise agreed upon with a Mintor representative and as quoted, within 30 (thirty) days of receipt of an invoice from Mintor by way of electronic funds transfer into such bank account as Mintor may elect from time to time.

Mintor has the right to deny access to the Service should the Recruiter payment not be received within 15 (fifteen) days of it becoming due, in which event the Recruiter will be unable to access the Service until such time as the outstanding fees are paid.

Mintor may change the fees charged for the Services at any time. Mintor will provide the Recruiter with reasonable prior written notice of any change in fees.

 

Warranties and Limitations of Liability

Mintor will not be responsible for any direct or incidental, indirect, special or consequential damages or loss of any nature whatsoever suffered by the Recruiter as a result of making use of the Service.

Furthermore, Mintor does not guarantee that all files made available on the platform or delivered via email will be free of infection or viruses, worms, Trojan horses or any other code that manifest contaminating or destructive properties.

Mintor does not warrant that the Service will meet the Recruiter requirements, and, for this purpose, it is specifically recorded that the Service is provided “as is” and it is the Recruiter’s responsibility to satisfy itself that it meets the Recruiter requirements and is compatible with the Recruiter hardware and software prior to making use thereof.

Mintor provides no warranty that the Service generally available through its platform shall remain uninterrupted or error-free or that defects in the Service will be corrected.

 

Indemnification

The Recruiter agrees to indemnify and hold harmless Mintor and its respective directors, officers, employees, agents or other representatives from and against all claims, liability and expenses, including all legal fees and costs arising from or relating to (a) breach by the Recruiter of these terms and conditions; and (b) unauthorised use or misuse of Services by the Recruiter. This provision shall survive the termination of the right of the Recruiter to make use of these Services.

 

Confidentiality

The Recruiter will not, during the currency of this Agreement and after the termination thereof, for its own benefit or for the benefit of any other person, use or derive any profit from:- 1) any informational knowledge in relation to the Services, acquired by reason of its engagement in terms of these terms and conditions; and 2) any confidential Information in general which relate to the business of Mintor, including (but not limited to) suppliers contact information, intellectual property, financial methods, policies, marketing methods, processes, systems, business methods, business connections, internal control systems and other matters which relate to the business of Mintor.

All information, presentations and ideas (electronic- or paper-based) devised by Mintor and used by the Recruiter shall be secret and confidential to the Recruiter and its selected employees and shall remain at all times the exclusive property of Mintor. If such information, presentations and ideas are furnished to the Recruiter, they shall remain in its possession and under its control until required to deliver same back to Mintor which the Recruiter will be obliged to do on demand or on termination of these terms and conditions, whichever is the sooner.

The Recruiter furthermore undertakes to take all reasonable precautions against and use its best endeavours to prevent any of that information mentioned above being learned by unauthorised persons.

Similarly, Mintor and its employees will keep confidential all job seeker data and take all reasonable precautions to prevent the job seeker data being accessed by unauthorised persons.

 

Intellectual Property

All Intellectual Property Rights in the Services, processes, manuals and other documentation connected with the Services and/or Mintor shall remain at all times the sole property of Mintor. Unless specifically authorised in these terms and conditions or in writing by Mintor and then only to the extent so authorised, the Recruiter shall have no right to use Mintor’s Intellectual Property in any manner whatsoever.

All content, trademarks and data on this platform, including but not limited to software, databases, text, graphics, icons, links, designs and agreements, are the property of or under license of Mintor. As such they are protected by local and international legislation and agreements. Users may download, view and print content from this platform only for private and non-commercial ends.

 

Personal information and Privacy

Mintor is a responsible party for purposes of the processing of Personal Information in the course of rendering the Services, as provided for by the Protection of Personal Information Act of 2013 (‘’POPIA’’). Mintor conforms to POPIA in terms of the collection, use and retention of Personal Information of job seekers. For purposes of these Terms and Conditions, “Personal Information” is defined in accordance with section 1 of POPIA.

Mintor undertakes that it shall ensure that it is entitled to lawfully use, process and transfer the Personal Information of job seekers to the Recruiter in the course of providing the Services in terms of these terms and conditions.

Mintor undertakes that it shall ensure that the job seekers have been informed of, and have given their consent to, such use, processing, and transfer as required by POPIA.

Mintor shall take appropriate technical and organisational measures against unauthorised or unlawful processing of the Personal Information or its accidental loss, destruction or damage.

 

Third party websites

Where links and pointers have been provided by Mintor to other third party websites, these links are provided without endorsement by Mintor. Mintor is not responsible for the content of linked third-party websites and does not make any representations regarding the content and accuracy of materials on such websites. Linking to third party websites is solely at the users own risk.

 

Use of the website

Users are prohibited to attempt any violations to the security of Mintor including, but not limited to an attempt to interfere with the host or network by submitting a virus to the platform, overloading or spamming, forging of TCP/IP packet header or any part of the header information in any email or newsgroup posting or by accessing information not intended for such user or logging into a server or account which the user is not authorised to access.

Users are prohibited from posting any information onto the Mintor platform that is obscene, offensive, vulgar, defamatory, threatening, harassing, abusive, hateful, racist, sexist, discriminatory, of a menacing character or embarrassing, or which may cause annoyance, anxiety or inconvenience to another user or any other person or entity; post a sexually-explicit image or statement; post advertisements or solicitations of business; post chain letters or pyramid schemes or that impersonates another person.

 

Arbitration

In the event of any dispute or difference arising between the Parties hereto relating to or arising out of this Agreement, including the implementation, execution, interpretation, rectification, termination or cancellation of this Agreement, the Parties shall forthwith meet to attempt to settle such dispute or difference, and failing such settlement within a period of sixty (60) days, the said dispute or difference may be submitted to arbitration on an informal basis in accordance with the provisions of the Arbitration Foundation of Southern Africa, which arbitration proceedings shall be held in Cape Town or such other place as the Parties may agree.

 

Notices

The Recruiter agrees that Mintor may provide notice to the Recruiter by sending it to the email address associated with the Recruiter’s registered account. All notices to Mintor must be sent to the following email address: support@gomintor.com.

 

Breach

Should any of the terms and conditions be breached by a Recruiter, Mintor, at its sole discretion reserves the right to suspend, alter or terminate Recruiter registration and access to the platform and the Services.

 

General

Should any part of these terms and conditions be held by a court of competent jurisdiction to be unenforceable, the validity and enforceability of the remainder of the terms and conditions shall not be affected.

Recruiters’ use of this platform is solely at Recruiters’ own risk and subject to all applicable laws in South Africa. Should Recruiters outside of this jurisdiction access the platform, they do so at their own risk and are responsible for compliance with applicable local laws and regulations.

These terms and conditions constitute the whole agreement between the parties and no party shall be bound by any undertakings, representations, warranties, promises or the like not recorded herein. Any indulgence of whatsoever nature granted by Mintor shall not be construed as a waiver or variation of any of our rights or remedies.

Mintor reserves the right to reference the Recruiter in marketing materials, on websites, in discussions, case studies and white papers and this right will continue even after termination of this Agreement.
